Terms of Service

Last updated:

1. Agreement to these terms

These Terms of Service ("Terms") are an agreement between you and CrateDiggr ("CrateDiggr", "we", "us") covering your use of the CrateDiggr browser extension, the CrateDiggr website and API, and any related services (together, the "Service"). By installing the extension, creating an account, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. What the Service is

The Service has two parts:

  • The browser extension highlights free downloads that artists have made available on SoundCloud, and can complete the steps of third-party download gates (such as follow-to-download pages) on your behalf so that a download you are entitled to takes one click instead of many. It also keeps a history of what you have saved.
  • The website hosts crowdsourced tracklists for DJ mixes, where signed-in users can identify tracks, suggest corrections to IDs, and see which identified tracks have a free download available.

CrateDiggr does not host SoundCloud's audio and is not a music streaming or file-sharing service. Free downloads are offered by the artists who upload them; CrateDiggr surfaces and automates access to what the artist has already chosen to give away.

3. Eligibility and accounts

You must be at least 13 years old (or the minimum age required to use online services in your country, if higher) to use the Service. Some features require an account. You agree to provide accurate registration information, keep your credentials confidential, and not share your account. You are responsible for all activity under your account. Tell us promptly at support@cratediggr.com if you believe your account has been compromised.

4. Third-party platforms and gate automation

The Service interacts with platforms we do not operate, including SoundCloud and download-gate providers such as Hypeddit, ToneDen, PumpYourSound, pl8list, Droploud, GateRush, Download Gater, Laylo, and Influence Planner. CrateDiggr is not affiliated with, endorsed by, or sponsored by any of them. Your use of those platforms is governed by their own terms, and you are responsible for complying with them.

When you click a CrateDiggr download button on a gated track, you instruct the extension to complete the gate's steps for you in your browser. That can include actions the gate requires, such as following or liking an artist on your connected accounts or submitting an email address. These actions are performed at your direction, using your own accounts and sessions, exactly as if you had clicked through the gate yourself. You authorize the extension to perform them, and the engagement the artist asked for still happens.

Third-party platforms change without notice. Features that depend on them can stop working at any time, and we do not guarantee that any particular integration will keep working.

5. Downloads and music rights

The Service is built for downloads that artists have made available: SoundCloud's own download option and free-download gates the artist set up. All rights in the music remain with the artists and rights holders. Downloading a file does not give you ownership of the recording or any licence beyond what the artist grants. You are responsible for how you use downloaded files, including in public performances, broadcasts, mixes, or re-uploads.

You agree not to use the Service to obtain content you are not entitled to, or to circumvent digital rights management or other technical protection measures.

6. Your content

You keep ownership of the content you submit to the Service, including tracklist entries, track IDs, suggested corrections, and any files you upload. By submitting content you grant CrateDiggr a non-exclusive, worldwide, royalty-free licence to host, display, distribute, and use it to operate and promote the Service. Crowdsourced contributions (such as track IDs) remain available to other users even if you later close your account.

You are responsible for what you submit. You warrant that you have the rights needed to submit it, and that it does not infringe anyone's intellectual property or other rights. If you upload files for distribution through CrateDiggr, you warrant that you own or control the rights to distribute them. We may remove or edit content that violates these Terms, is inaccurate, or is abusive, and we may moderate crowdsourced data (for example, resolving conflicting track IDs) to keep it useful.

We respect the rights of artists and rights holders. If you believe content available through the Service infringes your copyright, email support@cratediggr.com with: (a) identification of the work you claim is infringed, (b) the URL or location of the material on our Service, (c) your contact details, (d) a statement that you believe in good faith the use is not authorized, and (e) a statement, under penalty of perjury, that the information is accurate and that you are the rights holder or authorized to act for them. We will remove or disable access to infringing material and terminate the accounts of repeat infringers.

8. Subscriptions and billing

The core extension is free. Optional Pro features are available as a paid subscription, billed in advance on a recurring basis through our payment processor, Stripe. By subscribing you authorize recurring charges to your payment method until you cancel.

  • Trials. If your subscription starts with a free trial, your payment method is charged automatically when the trial ends unless you cancel before then.
  • Cancellation. You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period, and you keep Pro access until then.
  • Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods.
  • Price changes. We may change subscription pricing with reasonable advance notice; changes apply from your next billing period.

9. Acceptable use

You agree not to:

  • use the Service in violation of any law or third-party right;
  • submit false or misleading crowdsourced data on purpose, spam tracklists, or tamper with track IDs or suggested corrections;
  • probe, overload, or disrupt the Service, evade rate limits, or access it by automated means other than the extension and documented interfaces;
  • resell, sublicense, or provide the Service to third parties as your own offering;
  • share Pro access across accounts, or use another user's credentials;
  • reverse engineer the Service except where the law says we cannot restrict it; or
  • impersonate any person, or misrepresent your affiliation with anyone.

10. Suspension and termination

You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Where practical we will give you notice. Sections that by their nature should survive termination (including 5, 6, 11, 12, and 13) survive.

11. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that any particular download will be available or complete successfully, that crowdsourced tracklist data is accurate, or that integrations with third-party platforms will keep working.

12. Limitation of liability

To the fullest extent permitted by law, CrateDiggr and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from or related to the Service. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and CAD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify and hold CrateDiggr harmless from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service in breach of these Terms, or your violation of any law or third-party right.

14. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts located in Ontario have exclusive jurisdiction over disputes arising from these Terms, and each party consents to their jurisdiction. Nothing in this section deprives you of mandatory consumer protections of the place where you live.

15. Changes to the Service or these Terms

We may change or discontinue parts of the Service at any time. We may also update these Terms; if a change is material we will notify registered users by email or an in-product notice before it takes effect. Continued use of the Service after a change takes effect means you accept the updated Terms. The "Last updated" date above always reflects the current version.
